Court Grants Final Forfeiture of Property Allegedly Linked to Emefiele.

The Federal High Court in Lagos has issued a final forfeiture order for a warehouse situated on a 1.925-hectare parcel of land along the Lagos-Ibadan Expressway in Magboro, Ogun State.

The order also covers 54 general-purpose steel containers, now forfeited to the Federal Government.

Justice Deinde Dipeolu granted the order following an application by the Economic and Financial Crimes Commission (EFCC), which stated that the assets were reasonably suspected to be proceeds of unlawful activities tied to former Central Bank of Nigeria Governor, Godwin Emefiele.

The EFCC’s counsel, Rotimi Oyedepo (SAN), had earlier secured an interim forfeiture order on November 28 and complied with the court’s directive to publish the order in a national newspaper to invite potential claimants to the assets.

However, no claims were made within the stipulated timeframe.

The anti-graft agency brought the application under Section 44(2)(B) of the Nigerian Constitution (as amended), Section 17 of the Advance Fee Fraud and Other Fraud Related Offences Act 2006, and the court’s inherent jurisdiction.

Oyedepo urged the court to confirm the forfeiture of the warehouse and steel containers, citing their suspected connection to illicit financial activities.

After reviewing the application and supporting documentation, Justice Dipeolu granted the EFCC’s request, stating, “The application succeeds and is accordingly granted.

A final forfeiture order is hereby made, forfeiting the assets in Schedule A to the Federal Government of Nigeria.”
